Common use of Servicing Report Clause in Contracts

Servicing Report. On each Reporting Date, the Servicer will provide to the Seller, the Administrative Agent, each Purchaser Agent, the Trustee and the Backup Servicer and any Liquidity Bank, a monthly statement determined as of the related Determination Date (a “Servicing Report”), signed by a Responsible Officer of the Servicer and the Seller and substantially in the form of Exhibit C hereto (as such form may be amended from time to time by such changes as are mutually agreeable to the Servicer and the Administrative Agent) and, in addition, a Borrowing Base calculated as of the most recent Measurement Date.

On each Reporting Date, the Servicer will provide to the SellerBorrower, the Trustee, the Administrative Agent, each Purchaser Agent, the Trustee Agent and the Backup Servicer and any Liquidity Bank, a monthly statement determined as of the related Determination Date (a “Servicing Report”), signed by a Responsible Officer of the Servicer and the Seller Borrower and substantially in the form of Exhibit C hereto (as such form may be amended from time to time by such changes as are mutually agreeable to the Servicer Servicer, the Trustee and the Administrative Agent) and, in addition, a Borrowing Base calculated as of the most recent Measurement Date.

On each Reporting Date, the Servicer will provide to the SellerBorrower, the Administrative Agent, and each Purchaser Agent, the Trustee and the Backup Servicer and any Liquidity BankLender, a monthly statement determined including a Borrowing Base, calculated as of the related most recent Determination Date (a “Servicing Report”), with respect to the related calendar month, signed by a Responsible Officer of the Servicer and the Seller Borrower and substantially in the form of Exhibit C hereto (as such form may be amended from time to time C, and which shall include a certification by such changes as are mutually agreeable to the Servicer and the Administrative Agent) and, in addition, a Borrowing Base calculated as of the most recent Measurement DateResponsible Officer that no Termination Event or Unmatured Termination Event has occurred.
