Common use of SETOFF OF FINES Clause in Contracts

SETOFF OF FINES. 1. The setoff of fines is only permitted with regard to judicial and administrative fines owed by the agency worker, this in accordance with Section 7:632, subsection 1 under a. of the Dutch Civil Code. Owed is taken to mean fines imposed on the employment agency due to a violation by the agency worker of a legal or administrative provision. 2. Each individual setoff against the wage is specified in writing, if and insofar not already following on from Appendix II of the collective agreement. The employment agency ensures that the agency worker receives an overview of any possible setoff, in the national language of the agency worker.
