Common use of Settlement Administrator’s Fees and Costs Clause in Contracts

Settlement Administrator’s Fees and Costs. The Settlement Administrator’s fees and costs shall be paid from the Settlement Fund within 10 days after invoicing to and approval by Class Counsel and Defendant’s Counsel. In the event the Final Approval Order is not entered or this Agreement is terminated pursuant to Section XII below, the Settlement Fund will cover any costs incurred and fees charged by the Settlement Administrator prior to the denial of Final Approval or the termination of this Agreement.

The Settlement Administrator’s fees and costs costs, to the extent they exceed $500,000.00, shall be paid from the Settlement Fund within 10 days after invoicing to and approval by Class Counsel and Defendant’s CounselPlaintiffs. In the event the Final Approval Order is not entered or this Agreement is terminated pursuant to Section XII XIII below, the Settlement Fund will Defendant agrees to cover any costs incurred and fees charged by the Settlement Administrator up to $500,000 pursuant to the Settlement prior to the denial of Final Approval or the termination of this Agreement.

Settlement Administrator’s Fees and Costs. The Settlement Administrator’s fees and costs shall be paid from the Settlement Fund within 10 ten (10) days after invoicing to and approval by Class Counsel the Parties. The Parties and Defendant’s Counselthe Settlement Administrator agree that any fees or costs incurred by the Settlement Administrator prior to funding of the Settlement Fund shall be deferred and not invoiced until the Settlement Fund has been funded. In the event the Final Approval Order is not entered or this Agreement is terminated pursuant to Section XII 16 below, the Settlement Fund will Defendant agrees to cover any costs incurred and fees charged by the Settlement Administrator prior to the denial of a Final Approval Order or the termination of this Agreement.
