The Settlement Claims clause establishes the procedures and terms under which disputes or claims between parties are resolved, typically outside of court. Settlement Claims. (a) All Settlement Class Members shall be entitled to submit either a Paid Subscription Claim or a User Claim, by submitting a Claim Form (to seek payment from the Settlement Fund) prior to the Claim Deadline. Each Settlement Class Member is limited to one Settlement Claim. Settlement Class Members shall submit the Claim Form by mailing the Claim Form to the Settlement Administrator or submitting the Claim Form through the Settlement Website. Each Settlement Class Member with an Approved Claim shall be entitled to a Settlement Payment from the Settlement Fund pursuant to the terms and conditions of Section 2 of this Agreement or as otherwise approved by the Court.
Settlement Claims. We will accept your good faith decision in settling any claim except as specified in this Article. Once we have received the proofs cited in Section 1 and upon evidence of your settlement with the claimant, we will discharge our net reinsurance liability by paying you one lump sum regardless of the method of settlement you use. For the settlement of Waiver of Premium Disability or other Disability Rider benefits, we will pay you our proportional share of the grasp premium waived annually. You will consult with us before conceding any liability or making any settlement with the claimant for claims incurred during the contestable period of the policy. Your claim settlements will be administered in good faith, according to the standard procedures you apply to alt claims, whether reinsured or not.
Settlement Claims. Administrator means, subject to Court approval, CPT Group, unless another third-party administrator is later agreed to be the Parties in writing and approved by the Court.
