Common use of Settlement Class and Common Issue Clause in Contracts

Settlement Class and Common Issue. (1) The Parties agree that the Proceedings shall be certified or authorized as class proceedings as against the Settling Defendants solely for purposes of settlement of the Proceedings in respect of the Settling Defendants and the approval of this Settlement Agreement by the Courts, and such certification or authorization shall not be used or relied on as against the Releasees for any other purpose or in any other Proceeding. (2) The Parties agree that in the motions for certification or authorization of the Proceedings as class proceedings and for the approval of this Settlement Agreement the only common issue that the Plaintiffs and Class Counsel will seek to define is the Common Issue and the only classes that the Plaintiffs and Class Counsel will assert are the Settlement Classes.
