The respective obligations of the Lenders hereunder to make Revolving Loans, to fund participations in Letters of Credit and to make payments pursuant to Section 9.6(c) are several and not joint and no Lender shall be the partner or agent of any other (except to the extent to which the Agents are authorized to act as such)joint. The failure of any Lender to perform make any of its obligations Loan, to fund any such participation or to make any payment under Section 9.6(c) on any date required hereunder shall not relieve any other Lender from any of its obligations hereunder. Nothing in this Agreementcorresponding obligation to do so on such date, expressed or implied, and no Lender shall be responsible for the failure of any other Lender to so make its Loan, to purchase its participation or to make its payment under Section 9.6(c). This Agreement shall not be construed so as to confer any right or benefit upon any Person (other than the parties hereto, to this Agreement and their respective successors and assigns permitted hereby, Participants to the extent provided in Section 12.01(d) and, to the extent expressly contemplated hereby, the Related Parties of each of the Administrative Agent and the Lenders) any legal or equitable right, remedy or claim under or by reason of this Agreementassigns; provided, however, that the parties hereto expressly agree that each Arranger the Arrangers shall enjoy the benefits of the provisions of Sections 2.05(b)9.1, 9.069.6, 9.09 9.10 and 10.07 9.16 to the extent specifically set forth therein and each Arranger shall have the right to enforce such provisions on its own behalf and in its own name to the same extent as if it were a party to this Agreement.
