Common use of Several Obligations of Lenders Clause in Contracts

Several Obligations of Lenders. No Lender shall be responsible for the Commitments of any other Lenders. The failure of a Lender to make available its share of any Advance in accordance with this Agreement shall not release any other Lender from its obligations hereunder. Notwithstanding anything to the contrary in this Agreement, no Lender shall be obligated to make Advances under any Credit Facility (based on the Equivalent Amount thereof in Cdn. Dollars) in excess of its applicable Commitment thereunder. The obligation of each Lender to make its Commitment available to the Borrowers under a Credit Facility is a separate obligation between that Lender and the Borrowers and such obligation is not the joint or the joint and several obligation of any other Lender.
