Severance Pay – Fixed Term. 55.11.1 Where the employee is appointed on a fixed term basis and is not offered further employment at the end of their appointment they will be entitled to a severance payment in accordance with Table 55.11.2 if:
55.11.1.1 the employee is employed on a second or subsequent fixed term appointment and the same or substantially similar duties are no longer required by the University; or
55.11.1.2 the duties performed continue to be required but another person has beenappointed, or is to be appointed, to do the same or substantially similar duties.
55.11.2 Severance Pay – Fixed Term Period of Continuous Service Severance Pay Less than 1 year Nil 1 year and up to completion of 2 years 4 weeks’ pay 2 years and up to the completion of 3 years 6 weeks’ pay 3 years and up to the completion of 4 years 7 weeks’ pay 4 years and up to the completion of 5 years 8 weeks’ pay 5 years and up to the completion of 6 years 10 weeks’ pay 6 years and up to the completion of 7 years 11 weeks’ pay 7 years and up to the completion of 8 years 13 weeks’ pay 8 years and up to the completion of 9 years 14 weeks’ pay 9 years and up to the completion of 10 years 16 weeks’ pay 10 years and over 18 weeks’ pay
55.11.3 The employee will not be entitled to any severance payment if appointed on a fixed term basis as a: 55.11.3.1 temporary replacement for another employee; or
Severance Pay – Fixed Term. 39.10.1 Where the staff member is appointed on a fixed term basis and is not offered further employment at the end of their appointment but is seeking further employment, they will be entitled to a severance payment in accordance with Table 1, within sub-clause 39.10, if:
39.10.1.1 the staff member is employed on a second or subsequent fixed term appointment and the same or substantially similar duties are no longer required by the University; or
39.10.1.2 the duties performed continue to be required but another person has been appointed, or is to be appointed, to do the same or substantially similar duties. 39.10.2 The staff member will not be entitled to any severance payment if appointed on a fixed term basis as a:
39.10.2.1 temporary replacement for another staff member; or
39.10.2.2 pre-retirement appointment.
39.10.3 The severance payment shall not exceed the amount which the staff member would have earned if employment with the University had proceeded to the staff member’s nominated retirement date.
39.10.4 Where the University provides the staff member with written notice within 6 weeks of their appointment end date that further employment may be offered, the University may defer any severance payment for up to 4 weeks from their appointment end date.
