Common use of Severed Lands Clause in Contracts

Severed Lands. Where the Property Owner seeks to sever the Property, the Special Charge (Actual) shall be: (1) Reapportioned among the new lots in any manner the City considers just and equitable, having regard to the relative degree of benefit received by each of the new lot, and a new special charge will be imposed on each of the new lots in the amount apportioned to each lot; or (2) Paid in full at the time of the City approval for the severance.
