Common use of SEVERENCE Clause in Contracts

SEVERENCE. 38.1 A provision of the Agreement that is void, illegal or unenforceable is ineffective only to the extent of the provision’s illegality or unenforceability, but the remaining provisions are not affected. 38.2 Any present or future legislation which operates to vary the Client’s obligations in connection with this Agreement with the result that Xxxx Private Capital’s rights, powers or remedies are adversely affected (including by way of delay or postponement) is excluded except to the extent that its exclusion is prohibited or rendered ineffective by law.
