Common use of SFDC’S Liability for Breach of Cardinal Duties Clause in Contracts

SFDC’S Liability for Breach of Cardinal Duties. If cardinal duties of SFDC are infringed due to slight negligence and if, as a consequence, the achievement of the objective of this Agreement including any applicable Order Form is endangered, or in the case of a slightly negligent failure to comply with duties, the very discharge of which is an essential prerequisite for the proper performance of this Agreement (including any applicable Order Form), SFDC’s liability shall be limited to foreseeable damage typical for the contract. In all other respects, any liability of SFDC for damage caused by slight negligence shall be excluded.
