Common use of Shared Privileges Clause in Contracts

Shared Privileges. (i) The parties hereto agree that they shall have a shared Privilege, with equal right to assert or waive, subject to the restrictions in this Section 9.6(b)(i), with respect to all Privileges ----------------- not allocated pursuant to the terms of Section 9.6(a) above. All -------------- Privileges relating to any claims, proceedings, litigation, disputes, or other matters which involve two or more of Columbia/HCA, LifePoint or Triad and in respect of which two or more of such parties retain any responsibility or liability under this Agreement, shall be subject to a shared Privilege among them.
