Sharing of Information with Beneficiaries. The Contractor shall not prohibit nor otherwise restrict, a licensed, waivered, or registered professional, as defined in Cal. Code Regs., tit. 9, §§ 1810.223 and 1810.254, who is acting within the lawful scope of practice (pursuant to 42 C.F.R. § 438.102(a)(1)), from advising or advocating on behalf of a beneficiary for whom the provider is providing mental health services for any of the following: 1) The beneficiary’s health status, medical care, or treatment options, including any alternative treatment that may be self-administered; 2) Information on the beneficiary needs in order to decide among all relevant treatment options; 3) The risks, benefits, and consequences of treatment not receiving treatment ; and 4) The beneficiary’s right to participate in decisions regarding his or her health care, including the right to refuse treatment, and to express preferences about future treatment decisions.
