Shipper Conditions Precedent. Notwithstanding anything else in this Precedent Agreement to the contrary, Shipper’s obligation to execute the FTS Agreement is subject to the fulfillment or waiver by Shipper of each of the following conditions precedent (each a “Shipper Condition Precedent” and collectively the “Shipper Conditions Precedent”):
