Shipping Schedule. By the first Business Day of each month from and after the Effective Date, Customer shall provide Owner a non-binding, indicative schedule of the Shipment size and 15 day windows of each Shipment to be delivered to Customer over the following 3-month period.
Shipping Schedule. If the number of Files to be shipped pursuant to any one or more of the foregoing provisions of this Section 3.10 is one hundred fifty (150) or less and the Shipping Request is received by 10:30 a.m. (Denver time) on a Business Day, the Buyer will use its best efforts to ship the Files on that same Business Day. If more than one hundred fifty (150) Files are to be shipped or the Shipping Request is received later than 10:00 AM (but not later than 2:00 PM) on a Business Day, the Buyer will use its best efforts to ship them on the next Business Day, unless more than two hundred fifty (250) Files are to be shipped, in which event one additional Business Day shall be added for each increment of two hundred (200) files in excess of two hundred fifty (250) files to be shipped, limited to a maximum of ten (10) Business Days.
Shipping Schedule. RCDevs shall use its reasonable efforts to ship Products to Purchaser in accordance with the shipment schedule provided by RCDevs to Purchaser. Delivery dates proposed by Purchaser in its purchase order or other documentation shall not be binding on RCDevs.
Shipping Schedule. Unless otherwise instructed by Buyer, Seller shall prepare delivery in accordance with the Shipping Schedule as set in Attachment-A.
Shipping Schedule. Commencing on the Commencement Date, Nordion shall deliver Product in accordance with the initial shipping schedule set out on Schedule E. Nordion and LMI agree to enter into good faith discussions, from time to time, to negotiate in good faith a revised shipping schedule that reflects the needs of LMI’s customers and, the parties as required and agreed, shall amend the shipping schedule as reasonably necessary to meet those needs taking into account Nordion’s Product production schedule, regulatory requirements, the availability of carriers and other logistical circumstances that may impact the manufacture and shipping of Product. In the event that the parties do not agree to a revised shipping schedule, Nordion shall continue to ship Product in accordance with the initial shipping schedule set out in Schedule E as unamended.
Shipping Schedule. Honeywell shall use reasonable efforts to ship Products to Customer in accordance with the shipment schedule provided to Honeywell by Customer. Honeywell reserves the right to ship Products as early as five (5) business days prior to the requested shipment date in order to accommodate Honeywell’s overall delivery schedules. Notwithstanding the foregoing and without limiting the generality of Section 10 below, Honeywell shall not be liable for damages of any kind as a result of a delay in delivery for any reason.
Shipping Schedule. 3.1 Shipment dates are approximate and represent Xxxxxx's best judgment at the time of quotation. Estimations of shipping dates are made in good faith, but they are NOT guarantees and are not the essence of an Order.
3.2 Seller reserves the right to make shipment in lots. Upon shipment of each lot, Seller shall have the right to immediately invoice an amount representing that appropriate portion of the total selling price.
3.3 Seller shall have the right to manufacture the Goods to be provided pursuant to these T&C’s as far in advance of its estimated shipping schedule as it deems appropriate in its sole discretion. Seller reserves the right to ship in advance of any Buyer request dates, except those dates stipulated "not before".
3.4 Should shipment be held beyond scheduled date for the convenience of Buyer, the Seller reserves the right to bill immediately for the Goods and to charge Buyer for all expenses incident to such delay, including but not limited to storage of the Goods.
3.5 Seller will not be responsible for deviations in meeting specified shipping schedules nor for any losses, claims or damages to Buyer (or any third person) occasioned by deviation in the performance or the non-performance of any of Seller’s obligations hereunder, or by loss of or damages to the Goods when caused directly or indirectly by, or in any manner arising from, any casualty, riots, acts of Buyer, strikes, or by other labor difficulties, shortages of labor, supplies, and transportation facilities or any other similar or different cause or causes beyond Seller’s reasonable control or the reasonable control of its suppliers or subcontractors.
Shipping Schedule. If the number of Files to be shipped pursuant to any one or more of the foregoing provisions of this Section 4 is 150 or less and the Shipping Request is received by 10:30 AM (Minneapolis time) on a Business Day, the Custodian will use its best efforts to ship the Files on that same Business Day. If more than 150 files are to be shipped or the Shipping Request is received later than 10:30 AM (but not later than 2:00 PM) on a Business Day, the Custodian will use its best efforts to ship them on the next Business Day, unless more than 250 Files are to be shipped, in which event one additional Business Day shall be added for each increment of 200 files in excess of 250 files to be shipped, limited to a maximum of 10 Business Days.
Shipping Schedule. During the term of this Agreement, each ConAgra Distribution Company shall, not later than June 1 and December 1 of each Year, provide Seller with an itemized monthly shipping schedule for the Products covering its anticipated purchases of Products for the following six (6) Months ("Estimates"). Each ConAgra Distribution Company shall use its commercially reasonable efforts to update such Estimates monthly.
Shipping Schedule. After the Company has accepted the Purchase Order, the Company will use its best efforts, subject to Section 26 of this Agreement entitled “Force Majeure,” to ship any orders received from Distributor within 45 calendar days after acceptance of the Purchase Order. All invoices shall be payable net 30 days from date of shipment.
