SIMULTANEOUS OPTIONS. Subject to the other provisions of this Agreement, if the Partnership already has notified ALZA of the Completion of a Product in accordance with Section 2.2 prior to determining to discontinue the Product Development Program for that Product, then ALZA will have a simultaneous License Option and Continuation Option for such Discontinued Product, and ALZA may exercise either or both such options in accordance with the applicable provisions of this Agreement.
