Common use of SIXTEENTH Clause in Contracts

SIXTEENTH. (A) This Plan and Agreement may be terminated at any time with respect to a Company and/or any Fund thereof, without the payment of any penalty, by vote of a majority of the Independent Directors of the Company or by vote of a majority of the outstanding voting securities of Class C Shares of the Company or Fund, as applicable, or by the Distributor, on sixty (60) days' written notice to the other party.
