Common use of Small Business Contracts Clause in Contracts

Small Business Contracts. If this Contract is a Small Business Contract (as defined in in Schedule 2, Section 23 of the (a) in the circumstances and to the extent practicable, provide a reasonable opportunity for the Supplier to remedy a default under clause 13.4; (b) act reasonably in exercising its rights under clause 8.5; and (c) reduce proportionately any obligation of the Supplier to indemnify the Company to the extent that the Company’s breach or negligence contributed to the loss or damage.

Small Business Contracts. If this Contract is a Small Business Contract (as defined in in Schedule 2, Section 23 of thethe Competition and Consumer Act 2010) the Company will: (a) in the circumstances and to the extent practicable, provide a reasonable opportunity for the Supplier to remedy a default under clause 13.4; (b) act reasonably in exercising its rights under clause 8.5; and (c) reduce proportionately any obligation of the Supplier to indemnify the Company to the extent that the Company’s breach or negligence contributed to the loss or damage.
