Common use of SOLE DUTY OF CUSTODIAN Clause in Contracts

SOLE DUTY OF CUSTODIAN. Custodian's sole obligation with respect to the redemption of limited partnership interests in the Fund and distributions thereon shall be its obligation set forth in Section 4.1 above, and Custodian shall not be required to make any payments to the limited partners in the Fund nor shall Custodian be responsible for the payment or distribution by the Fund, or any agent designated in Proper Instructions given pursuant to Section 4.1 above, of any amount paid by Custodian to the account of the Fund or such agent in accordance with such Proper Instructions.
