Sole Occupancy By Tenant. Tenant acknowledges that Tenant will be the sole occupant of the Building for a period of the Term until such time that Landlord begins occupying a portion of the Building or otherwise leases space to a third party. Notwithstanding anything to the contrary contained in this Lease, for such period in which Tenant is the sole occupant of the Building, Tenant shall pay thirty percent (30%) (and not Tenant’s Proportionate Share) of the Operating Expenses actually incurred as Additional Rent in accordance with this Section 4.
