Common use of SPACE PLAN; CONSTRUCTION OF IMPROVEMENTS Clause in Contracts

SPACE PLAN; CONSTRUCTION OF IMPROVEMENTS. Landlord and Tenant have approved the space plan for the Premises dated April 3, 2019 attached hereto as Schedule 1 (the “Space Plan”). Landlord, at Landlord’s cost and expense, shall construct improvements affixed to the Premises on a turnkey basis pursuant to the Space Plan to include both the building standard finishes and the alternates (except that carpets shall be replaced in private offices), and as described on Schedule 2 attached hereto (the “Tenant Improvements”); provided that the Tenant Improvements shall not include furniture, fixtures, equipment or other personal property. Landlord shall construct the Tenant Improvements in accordance with all applicable Laws, including, without limitation, the Americans with Disabilities Act, as amended (the ADA). Landlord and Xxxxxx acknowledge that the Space Plan is subject to modification if necessary in order to obtain all applicable governmental permits and approvals. Unless specifically noted to the contrary on the Space Plan or Schedule 2, the Tenant Improvements shall be constructed using Building-standard specifications and materials.
