Common use of SPECIAL NOTICE OF AMERICAN’S WITH DISABILITIES ACT Clause in Contracts

SPECIAL NOTICE OF AMERICAN’S WITH DISABILITIES ACT. Some of the requirements in the Construction Documents are meant to comply with the American’s with Disabilities Act (“ADA”). The requirements of the ADA are technical in nature and may appear to be minor in nature (i.e. whether a walkway or ramp has a 2% cross-slope). Contractor is warned that even the slightest deviation from the specific requirements from the ADA is considered a Civil Rights Violation and subjects the District to fines of three times actual damages sustained by a handicap individual or up to $4,000 per violation and attorney’s fees required to enforce the ADA violation. As a result of the significant liability and exposure associated with ADA aspects of the Contract, Contractor shall take special care to meet all ADA requirements detailed in the Construction Documents. Failure to comply with ADA rules that results in a Notice of Non-Compliance shall be repaired to meet ADA requirements promptly. In addition, any ADA violations that are not identified by Inspector or Architect that are later identified shall be repaired and charged back to the Contractor through a Deductive Change Order.
