Common use of Specific Performance Against Seller Clause in Contracts

Specific Performance Against Seller. The sole and exclusive remedy of the Purchaser in the event of a Default by the Seller hereunder shall be (i) to terminate this Agreement as provided in Section 10.1.2., without any claim for and waving any right to collect damages, or (ii) to pursue legal action to obtain specific performance of the Seller's obligations hereunder. The Seller acknowledges and agrees that the Purchaser shall have the right to seek specific performance of this Agreement against the Seller in the event of a Default by the Seller hereunder.
