Specific Performance—Other Covenants. Prior to the valid termination of this Agreement pursuant to Article VII and other than as it relates to the right to cause the Equity Financing to be funded and to consummate the Merger (which are governed by the provisions of Section 8.8(b)(i)), the Company shall be entitled to seek and obtain an injunction, specific performance and other equitable relief to prevent breaches of this Agreement by Parent and Merger Sub and to enforce specifically the terms and provisions hereof (including, but not limited to demanding Parent and Merger Sub to use commercially reasonable best efforts to secure the Debt Financing).
