Standard Software. The following is a list of the standard licensed software applications supported by the KCFC Technology Services Department. This list may not include all software applications supported. Due to the unique processing requirements of each agency, there may be specific software products used by an agency that KCFC Technology Services will work with the agency and its vendors to support. Microsoft products are subject to an end-of-life cycle. Once a product reaches extended end of life, Microsoft will no longer release security updates, and the software then presents a significant security risk for the Kenton County network. KCFC Technology Services works on behalf of agencies to update and upgrade their software pursuant to security requirements. Windows 2012*, Windows 2016, Windows 2019, Windows 2022 *Microsoft has issued end-of-life support warranties for the Server 2012 operating system for October 2023. Because this operating system will no longer be supported by Microsoft, KCFC Technology Services is phasing it out of the computing environment through a managed upgrade plan. This plan may include upgrading specific software applications in use by agencies that are running on servers with this older operating system. Standard Software. Software comprised of firmware or standard software (including, but not limited to packaged software, EESCO’s or Rockwell Automation’s preexisting templates, models and library files, and commercially available software) (collectively “Standard Software”) is subject to Customer’s acceptance of additional terms and conditions set forth in separate EESCO or Rockwell Automation or third- party click-wrap license agreements provided with such Standard Software. Such terms and conditions shall be the exclusive terms and conditions applicable to such Standard Software, excluding Customer’s obligation to pay any license fee which shall be identified in the Statement of Work.
Standard Software. The subject matter of this agreement is:
(i) Licenses for the WAMAS products (hereinafter collectively "standard software"); and/or
(ii) Licenses for the WAMAS add-on modules; and/or
(iii) Licenses for the automation components; and/or
(iv) User licenses (hereinafter collectively "licenses") which the licensee acquires from us as evidenced by the respective purchase order or the respective contract. This is to be distinguished from customization software, which is created by adapting and/or configuring the WAMAS standard software and is not covered by the scope of these license agreement terms.

Upon notification of the readiness of the WORKS AND/OR EQUIPMENT for the first operation to the BUYER (item 17 of the GENERAL CONDITIONS) the CONTRACTOR grants the BUYER the license, (sublicense) for the STANDARD SOFTWARE, with the globally effective territorial range, binding for indefinite time. The provisions of the GENERAL CONDITIONS shall apply in the remaining scope, including item 31.5.1.
Standard Software. For a period of [* * *], Supplier warrants that such Software substantially conforms to Specifications. AT&T’s sole and exclusive remedy under this limited warranty will be, for Supplier to, repair or replace nonconforming Software, or if repair or replacement is not possible, to refund the fees paid by AT&T for such non-conforming Software.

Standard Software. PROGNOST warrants that the software sold to Purchaser will be free from clerical errors and will perform the functions defined in the applicable specifications. Standard Software. Upon the Customer’s acceptance of Standard Software, the Customer acquires a right to use the Standard Software in accordance with the rights holder’s standard provisions as set out in Appendix 15. The right of use is indefinite unless otherwise specifically provided in Appendix 15. If the Contract covers maintenance of Standard Software, the Customer will receive a cor- responding right of use in respect of any subsequent change to the Standard Software. The Customer’s right of use in respect of Standard Software also includes a right for the Customer itself or by a third party to maintain the Standard Software unless otherwise stated in Appendix 15. Apart from the assignments mentioned in clause 25, the Customer may assign its rights in the Supplier’s Standard Software to a third party according to the provisions of Appendix 15.
