Common use of Standard Waiver Clause in Contracts

Standard Waiver. Upon acceptance of the Standard Waiver for collision, damage or theft, the Renter agrees to pay the Damage Liability Amount (ZAR 30, 000.00) applicable in respect of any damage and/or loss suffered from any cause whatsoever, including hail damage, subject to the following exclusions, in which event the Renter will be held liable in full for payment of all damages in terms of this Rental Agreement: - (a) Gross Negligence, including speeding (Exceeding the applicable speed limit) ; (b) Where damage was caused to upholstery and/or carpets; (c) Where damage and/or loss is sustained to tyres and/or rims and/or hubcaps and or glass/auto-glass of the Vehicle; (d) In the event of a collision and/or loss of the Vehicle which is not reported within twenty-four (24) hours as required; (e) Where the Vehicle was driven in or to a country and/or area, for which prior written approval was not obtained from the Company; (f) Where a non-designated driver or drivers have caused the loss and/or damage; (g) Where the damage/loss is sustained as a result of civil unrest, riot, war or political unrest; (h) Where the damage/loss is sustained by water and under-carriage or suspension damage or either; (i) Where the damage/loss is caused by driver fatigue or falling asleep behind the wheel; (j) Unauthorised salvage and/or towing and/or release fees; (k) Contravention or breach of any term of this Rental Agreement by Renter or Additional Driver; (l) Single vehicle roll-over. A roll over is defined as a vehicle sustaining all types of damage due to it not being on all 4 wheels; (the vehicle being on its side is construed as a roll over) Single vehicle accidents are included in all liability cover options, except in the case of roll-overs. (m) Double standard excess apply to single vehicle accidents. Standard cover excess = ZAR 30, 000.00 x 2 = ZAR 60, 000.00 (Repairs less than ZAR 60, 000.00 will be refunded) (n) Damage caused to equipment such as Canopy, Rooftop tents, Awnings and Fridges.

Tyre and Windscreen damage waiver can be purchased at an additional cost of ZAR 50.00 per day for Tyre damage (covers 1 Tyre) and ZAR50.00 per day for Windscreen damage (Covers 1 Windscreen).

Upon acceptance of the Standard Waiver for collision, damage or theft, the Renter Hirer agrees to pay the Damage Liability Amount (ZAR 30, 000.00) excess applicable in respect of any damage and/or and / or loss suffered from any cause whatsoever, including hail damage, subject to the following exclusions, in which event the Renter Hirer will be held liable in full for payment of all damages in terms of this Rental Agreement: -agreement:- (a) Gross Negligence, including speeding (Exceeding the applicable speed limit) Hirer or riders negligence; (b) Where no other motorcycle, animal, alternatively object, was involved in causing the damage was caused to upholstery and/or carpetsor loss suffered; (c) Where the motorcycle was driven in conditions in which, alternatively under which, the hirer restricted same; (d) Where damage and/or loss is sustained to tyres and/or and / or rims and/or and / or hubcaps and or glass/auto-glass of the Vehiclemotorcycle; (de) In the event of a collision and/or loss of the Vehicle which is not reported within twenty-twenty four (24) hours as required; (ef) Where the Vehicle motorcycle was driven in or to a country and/or and / or area, for which prior written approval was not obtained from the Company; (fg) Where the Hirer and / or the rider are under twenty one (21) years of age; (h) Where a non-designated driver rider or drivers riders have caused the loss and/or damage; (gi) Where here the damage/damage and / loss is sustained as a result of civil unrest, riot, war or political unrest; (hj) Where the damage/damage and / loss is sustained by water and under-carriage or suspension damage or either; (ik) Where the damage/loss is caused by driver fatigue or falling asleep behind the wheel; (j) Unauthorised Unauthorized salvage and/or towing and/or release fees;. (d) Reversing into any object/motorcycle/motor vehicle. (e) Hitting another motorcycle/motor vehicle from behind.
