Standards and Principles. The Administration and AAUP-CSU subscribe to the principles of due process and adhere to the concepts of progressive discipline and fair hearings as expressed in this Article.
Standards and Principles a. All grievance forms shall include the name and position of the aggrieved party, a concise statement of the complaint, supporting facts and the provision of law, regulation or terms and conditions of employment to which the grievance applies.
b. All meetings involving grievances will be held during either unassigned time during the school day or after school hours, as established by mutual consent. All reasonable effort will be made to avoid interruption of classroom activity and to avoid involvement of students in any phase of the grievance procedure.
c. An aggrieved party shall have the right to be represented by the Association at all steps of this grievance procedure.
d. The presentation of complaints through the established grievance procedure shall be free from interference, coercion, restraint, discrimination or reprisal.
e. The District and the Association agree to facilitate any investigation which may be required and to make available any and all material and relevant documents, communications and records concerning the alleged grievance.
f. Step 2 hearings shall be tape recorded. One set of official records consisting of the tape recording and written minutes of the grievance proceeding and the disposition thereof shall be maintained for reference purposes, separate and apart from the personnel files, in the office of the Clerk of the Board. Costs of tape recordings shall be shared equally by the District and the Association.
g. Nothing herein contained shall be construed as limiting the right of any aggrieved party having a grievance, to discuss the matter informally with any appropriate member of the administration and having the grievance adjusted without intervention of the Association, provided the adjustment is not inconsistent with the terms of the Agreement.
h. The existence of procedure hereby established shall not be deemed to require any teacher to pursue the remedies herein provided and shall not, in any manner, impair or limit the right of any teacher to pursue any legal remedies available in any other form, except when such grievance is submitted to arbitration which shall constitute an election of remedies pursuant to the next section, Section 3.03(i).
