If STK does not obtain or lease such items of property which meet or exceed such agreed requirements, then EDS will not be responsible for any direct, adverse impact on STK, the Services or any applicable performance criteria, standards or milestones to the extent directly related to STK's failure to obtain or lease such items of property which meet or exceed such agreed requirements. Notwithstanding the preceding sentence, EDS will use Commercially Reasonable Efforts to mitigate such adverse impacts.

The minimum rate of pay and any other benefits to be offered in respect of the relevant position, and the intervals at which they would be paid. Manchester Staff Limited will make reasonable steps to ensure the suitability of each Applicant. However, the Client is responsible for conducting its own checks and must satisfy itself with the suitability of each Applicant.   • Compliance with Accessibility Standards All parties to this Agreement shall ensure that the plans for and the construction of all projects subject to this Agreement are in compliance with standards issued or approved by the Texas Department of Licensing and Regulation (TDLR) as meeting or consistent with minimum accessibility requirements of the Americans with Disabilities Act (P.L. 101-336) (ADA).

  • Program Requirements The parties shall comply with the Disadvantaged Business Enterprise Program requirements established in 49 CFR Part 26.
