Common use of State Government Programs Clause in Contracts

State Government Programs. If a Participant under the Plan is also a Medicaid recipient, any benefits for services, supplies, or appliances under the Plan will not be excluded solely because benefits are paid or payable for such services, supplies, or appliances under Medicaid. Any benefits available under the Plan will be payable to the Texas Department of Human Services to the extent required by the Texas Insurance Code; and • All benefits paid on behalf of a child or children under the Plan must be paid to the Texas Department of Human Services where;
