Common use of State Interagency Agreements Clause in Contracts

State Interagency Agreements. The Recipient may review an undertaking in accordance with the terms of an interagency agreement, in lieu of the other terms of this PA, if: 1) The interagency agreement was in negotiations by the Recipient and SHPO on or before February 5, 2010, and will be executed no later than February 19, 2010; 2) The Recipient and SHPO both agree through execution of this PA that the interagency agreement applies to the undertaking and provides a historic preservation review process that is similar to that provided by the other terms of this PA; and 3) DOE does not object to the use of the interagency agreement to fulfill the requirements of Section 106 of the NHPA for the undertakings.
