Common use of Statutes of Limitation Clause in Contracts

Statutes of Limitation. As between the parties to this Contract, any applicable statute of limitations for any act or failure to act shall commence to run on the date of District’s issuance of the final Certificate for Payment, or termination of this Contract, whichever is earlier, except for latent defects, for which the statute of limitation shall begin running upon discovery of the defect and its cause.
