Statutory Rights of Action. Subscribers resident in certain jurisdictions of Canada are entitled by applicable legislation to rights of action for damages or rescission as described in the Offering Memorandum. Such rights of action for rescission and damages shall be exercised by delivery of notice in writing by the Subscriber to the Fund at Suite 4330, 00 Xxxx Xxxxxx Xxxx, Xxxxxxx, Xxxxxxx X0X 0X0 (or at such other address as the Fund may direct, from time to time) within the time period specified in the legislation.
