Stay of Appeal Proceeding Pending Closing. Pursuant to the Unopposed Motion filed by NOVEC and supported by ODEC on December 18, 2007, and subject to any Order issued by the Court, NOVEC shall file a status report or motion with the Court of Appeals for The District of Columbia Circuit (the “Court”) within five business days of the Execution Date: (i) requesting that the Court hold in abeyance the Appeal Proceeding pending Closing; and (ii) advising the Court that NOVEC will file a motion to dismiss the Appeals Proceeding docket within five business days after Closing.
