STOLEN OR DAMAGED. All reasonable care will be taken of articles consigned, however, they are left at the Consignor's risk. DISPUTES: In the unlikely event of any dispute resulting in litigation, the prevailing party in such litigation shall recover from the other party the prevailing party's attorney's fee and costs, including any appeals.
STOLEN OR DAMAGED. If the Equipment is lost, stolen or damaged beyond fair wear and tear during the Hire Period (for any reason i.e. whether or not due to Your negligence), You will be liable for: Any costs incurred by Us to recover and repair or replace the Equipment; and The hire charges for that portion of the Hire Period during which the Equipment is being recovered and repaired or replaced. If the Equipment has broken down or become unsafe to use as a result of Your negligence, You will be liable for: Any costs incurred by Us to recover and repair or replace the Equipment; and The hire charges for that portion of the Hire Period during which the Equipment is being recovered and repaired or replaced. If You have provided Us with your credit card details (whether for the payment of hire charges under this Hire Agreement or otherwise), You specifically and irrevocably authorise Us to debit all amounts for which You become liable under clauses 10.1 and/or 10.2 to Your credit card.
