Storm Flows. Contractor shall be responsible for providing all necessary means to handle, carry through, or divert around its Work, all flows including storm flows and unforeseen subdrain, so as to prevent back-up, by-passing to the Bay, or flooding damage to property. The RWQCB has the power, derived from the Xxxxxx-Cologne Water Quality Control Act, to impose fines up to Twenty-Five Thousand Dollars ($25,000) per day (or portion thereof) for bypassing of flows to the San Francisco Bay, as well as any civil or criminal penalties imposed below pursuant to the Clean Water Act.

From the Execution Date, and for the duration of the Delivery Term, Seller shall take all commercially reasonable actions, including complying with all applicable registration and reporting requirements, and execute any and all documents or instruments necessary to enable Buyer to use all of the capacity of the Project, including Capacity Attributes, to be committed by Seller to Buyer pursuant to this Agreement to meet Buyer’s Resource Adequacy Requirements during the Delivery Term.

  • Final Accounting Upon the dissolution of the Company, a proper accounting shall be made from the date of the last previous accounting to the date of dissolution.
