Stormwater Easement. Grantor grants and conveys to Grantee, for the benefit of Town an irrevocable, permanent, non-exclusive easement over, across, under and through the Grantee’s Parcel for the following purposes: (i) the discharge and drainage of stormwater from the Town ROW over, across, under, and through Grantor’s Parcel and into SCS (located within Grantor’s Parcel); (ii) accepting, managing and treating in the SCS all stormwater, regardless of source, discharged from the Town’s ROW to Grantor’s Parcel; and (iii) perpetual vehicular and pedestrian ingress, egress, and regress necessary and appropriate for the Town to ensure that the SCS is adequately performing and operating in accordance with the Operating Covenant contained in this Agreement. (collectively, “Stormwater Easement”).
Stormwater Easement. City shall also convey a nonexclusive easement on the ▇▇▇▇▇▇ Park Property to Owner or an agreed upon designee for stormwater drainage and detention requirements for the residential and commercial development adjacent to the ▇▇▇▇▇▇ Park Property as described further in Paragraph 7 and Exhibit “C”. The stormwater drainage and detention on or about the ▇▇▇▇▇▇ Park Property, City Property, and ▇▇▇▇▇▇▇ Property is shown on Exhibit “A-3”.
Stormwater Easement. Prior to or at closing, Seller and Buyer mutually agree to execute a Stormwater Management Pond Easement and Management Agreement that establishes an easement for Buyer's use of a common area joint detention pond and an agreement for joint maintenance of the detention pond.
Stormwater Easement. The Parties grant each other non-exclusive perpetual easements (the “Storm Water Easement”), for drainage, storm water pipes, storm water ponding, storm water collection, storm water control improvements and for purposes and uses incident and related thereto, including, without limitation, the construction, maintenance, repair and replacement of storm water ponding, drainage, collection and control facilities purposes over, under, upon and across the Storm Water Easement Area for drainage into the underground storm water retention facilities located on the Church Property and the underground storm water retention facilities to be constructed on the Norway House Property.
Stormwater Easement. Prior to or at Closing, Seller shall provide Buyer with an easement across Seller's adjoining property for stormwater drainage to the joint retention pond.
