Common use of Student Privacy Clause in Contracts

Student Privacy. In order to protect the privacy of students enrolled at the Academy, the Academy board, subject to Section 11.29, shall not: a) Sell or otherwise provide to a for-profit business entity any personally identifiable information that is part of a pupil’s education records. This does not prohibit the Academy Board from: i. for students enrolled in the Academy, providing such information to an educational management organization that has a contract with the Academy and whose contract has not been disapproved by the University; ii. providing the information to a person or entity as necessary for standardized testing that measures a student’s academic progress and achievement; or iii. providing the information as necessary to a person that is providing educational support services to the student under a contract with either the Academy or an educational management organization that has a contract with the Academy and whose contract has not been disapproved by the University. b) The terms “education records” and “personally identifiable information” shall have the same meaning as defined in 34 CFR 99.3.
