Common use of Student Privacy Clause in Contracts

Student Privacy. In order to protect the privacy of students enrolled at the Academy, the Academy Board shall not: (a) sell or otherwise provide to a for-profit business entity any personally identifiable information that is part of a pupil’s education records. This subsection does not apply to any of the following situations: (i) for students enrolled in the Academy, providing such information to an educational management organization that has a contract with the Academy and whose contract has not been disapproved by the University; (ii) providing the information as necessary for standardized testing that measures a student’s academic progress and achievement; or (iii) providing the information as necessary to a person that is providing educational or educational support services to the student under a contract with either the Academy or an educational management organization that has a contract with the Academy and whose contract has not been disapproved by the University. (b) The terms “education records” and “personally identifiable information” shall have the same meaning as defined in MCL 380.1136.
