Subcontracting By Contractor. Any subcontract entered into by the Contractor for the purposes of fulfilling the obligations under a Contract must be in writing, authorized in advance by the Department and shall be consistent with and subject to the provisions of these Commonwealth Terms and Conditions and a Contract. Subcontracts will not relieve or discharge the Contractor from any duty, obligation, responsibility or liability arising under a Contract. The Department is entitled to copies of all subcontracts and shall not be bound by any provisions contained in a subcontract to which it is not a party.
Subcontracting By Contractor. 11.5.1 Except to the extent otherwise approved in advance in writing by Owner’s Authorized Representative, Contractor or its Affiliates may submit an Offer in accordance with Article 11.3 to do Work with its own forces, provided at least 50% of the labor by such work unit is performed by employees of Contractor or such Affiliate. If Contractor is selected to perform the work, the overhead and markup paid to Contractor shall be limited to the markups applicable to Change Order Work set forth in the General Conditions.
11.5.2 For those items for which Contractor or any of its subsidiaries intends to submit an Offer, such intent must be publicly announced with the solicitation for Offers required by Article 11.3.1, and Owner shall be notified in writing. All Offers for this work shall be delivered to Owner and publicly opened by Owner at an announced time, date, and place.
Subcontracting By Contractor. The Contractor may subcontract its obligation to carry out the Project and its obligations to perform the Existing Facilities O&M and the O&M only to:
(a) the respective subcontractors identified in Schedule 17 (Subcontractors); and
(b) any additional subcontractors approved in advance by the Province. The Contractor may replace a subcontractor or engage additional subcontractors only with the prior consent of the Province, such consent not to be unreasonably withheld (having regard to the reputation of and the technical, commercial and financial resources available to the proposed subcontractor). For greater certainty, in this Section 22.2, “subcontractors” means parties having a direct contractual relationship with the Contractor, and excludes subcontractors of such parties.

When the Department furnishes federal funds to the Contractor, which are being passed down to a subcontractor, the subcontract must contain a provision that the subcontractor will comply with applicable federal single audit, cost principles and administrative requirement standards. Subcontracts will not relieve or discharge the Contractor from any duty, obligation, responsibility or liability arising under a Contract. The Department is entitled to copies of all subcontracts and shall not be bound by any provisions contained in a subcontract to which it is not a party.
Subcontracting By Contractor. Neither the whole nor any part of the Work may be subcontracted by the Contractor without the consent of the Owner. It shall be the Contractors’ responsibility for each subcontract issued that the Subcontractor comply with all terms and conditions of this Contract. The Contractor shall be held responsible to the Owner for the acts and omissions of its Subcontractors for their portion of the Work and of persons directly or indirectly employed by them, as for the acts and omissions of persons directly employed by them. Nothing contained in the Contract Documents shall create any contractual relation between any Subcontractor and the Owner.
Subcontracting By Contractor. .1 The Contractor must not without the Principal’s prior written consent (which will not be unreasonably withheld or delayed), subcontract to a third party any of its obligations under this Agreement.
Subcontracting By Contractor. 9.4.1 Except to the extent otherwise approved in advance in writing by Owner’s Authorized Representative, the Contractor or its Affiliates may submit an Offer to do Work with their own forces.
9.4.2 For those items for which the Contractor or any of its subsidiaries intends to submit an Offer, such intent must be publicly announced with the solicitation for Offers required by Section 9.3.1, and Owner must be notified in writing. All Offers for this work shall be delivered to Owner and publicly opened by Owner at an announced time, date, and place.
Subcontracting By Contractor. 11.5.1 Except to the extent otherwise approved in advance in writing by City’s Authorized Representative, Contractor (or its Affiliates) may submit an Offer in accordance with Article 11.3 to perform Work if at least fifty percent (50%) of the labor for such Work is performed by Contractor’s (or the Affiliate’s, if applicable).
11.5.2 If Contractor or any of its Affiliates intends to submit an Offer for any portion of the Work to be awarded through a competitive process, Contractor will disclose such intent in all solicitation documents and advertisements for Offers required by Article 11.3.3, and will notify City in writing. All Offers submitted, including the Offer of Contractor or its Affiliate, will be delivered to City in a sealed envelope and publicly opened by City at an announced time, date, and place. The City will evaluate all Offers received in accordance with the criteria stated in the solicitation document as provided in Article 11.3.3 or Article 11.3.4, as applicable, for the portion of the Work to be awarded and provide notice to all Offerors of the Subcontractor selected following such evaluation. Subject to City’s right to reject any or all Offers, the portion of the Work solicited will be awarded to the responsible bidder with the lowest responsive bid or the responsible proposer with the highest-ranked proposal.
11.5.3 Except as provided for in Article 11.4, Contractor may not self-perform any portion of the Work, or subcontract with an Affiliate, without competition from independent Subcontractors, unless Contractor provides, or had included in Contractor’s Proposal, a detailed proposal for performance of a specified portion of the Work by Contractor or an Affiliate. If required by City, Contractor’s proposal to perform the construction Work must be supported by at least one independent cost estimate prior to the Work being included in the Contract.
