Subdivision Approvals Clause Samples
The Subdivision Approvals clause outlines the requirements and procedures for obtaining necessary governmental or regulatory approvals to subdivide a property. Typically, this clause specifies which party is responsible for seeking approvals, the timeframe for doing so, and any conditions that must be met before the subdivision can proceed. For example, it may require the seller to secure local council consent or ensure compliance with zoning laws before the sale is finalized. The core function of this clause is to ensure that the subdivision process is clearly managed and that both parties understand their obligations, thereby reducing the risk of delays or disputes related to property division.
Subdivision Approvals. Seller shall have obtained all necessary parcel transfer and subdivision approvals required for the conveyance and transfer of the Property to Buyer. Buyer shall have obtained assurances that the Buyer may obtain any fu1iher parcel transfer and subdivision approvals required for the Intended Use.
Subdivision Approvals. Seller shall have either (i) received the necessary Legal Approvals from the applicable Governmental Bodies for any and all subdivisions necessary to separate the Owned Real Property from the Retained Real Property pursuant to one or more subdivision plans or plats reasonably acceptable to Buyer, which subdivision plans and plats shall have been recorded in the applicable Governmental Body recording offices, or (ii) delivered lease and purchase arrangements reasonably satisfactory to Buyer with respect to any such Owned Real Property for which such Legal Approvals are pending.
Subdivision Approvals. Purchaser has obtained all requisite Subdivision Approvals from the appropriate governmental authorities and registered the Survey prior to Closing; and

Without limiting the foregoing, all applicable subdivision approvals relating to the Hockessin Real Property that are required under applicable law have been obtained, all appeal periods relating thereto have expired with no appeals having been filed or all appeals having been conclusively decided in favor of the owner of the Hockessin Real Property.
