Subject of the warranty. Seller shall deliver goods and/or services without material and legal defects and with the agreed qualities/characteristics. The goods or works shall conform to the latest state of the art as well as to the relevant regulations as issued by authorities and professional associations. Seller and Buyer agree that all product, performance and process specifications and documentation referenced by the Order or the Order Confirmation shall be agreed quality/characteristics and workmanship standards for the Order. Xxxxx shall also be entitled to claims for defects if due to gross negligence Buyer has no knowledge of the defect.
