Subject to subclause F4 Clause Samples
The clause 'Subject to subclause F4' establishes that the provisions or obligations in the current section are conditional upon, or must be interpreted in light of, the terms set out in subclause F4. In practice, this means that if there is any conflict or overlap between the current clause and subclause F4, the terms of F4 will take precedence or modify the application of the current clause. For example, if the current clause sets a general rule but F4 provides an exception or additional requirement, the exception or requirement in F4 will govern. This approach ensures clarity and hierarchy within the contract, preventing contradictions and ensuring that specific provisions are properly prioritized.
Subject to subclause F4. 40, an application by an employee for personal leave during a period that would otherwise be an unpaid period of birth leave will be granted subject to the employee providing a certificate from a registered medical practitioner or registered health professional operating within their scope of practice to the extent of available entitlements.
