Common use of Sublease by the Company Clause in Contracts

Sublease by the Company. The Company may sublease the Project to the Subtenant and other subtenants pursuant to the terms of the PILOT Agreement. In the event of any such subleasing, the Company shall remain fully liable for the performance of its duties and obligations hereunder, and no such subleasing and no dealings or transactions between the Issuer or the Trustee and any such subtenant shall relieve the Company of any of its duties and obligations hereunder. All subleases shall be subject and subordinate in all respects to the provisions of this Lease. Nothing in this Lease shall allow the Issuer, its successors or assigns, to disturb the rights of any subtenant of the Company to use the Project under the terms and conditions as set forth in such subtenant’s sublease with the Company.
