Submission Items. Contributor makes no representation as to the completeness or accuracy of any of the other Contributor Disclosure Materials.
Submission Items. All materials, information, records, and documentation delivered or to be delivered to Purchaser by Seller pursuant to this Agreement, including the Seller’s Disclosure Materials, are or upon submission will be complete, accurate, true and correct in all material respects.

Submission Items. (a) Within 5 days after the Effective Date, Seller will make available to Purchaser (to the extent in Seller’s possession or control), for Purchaser’s review and approval, the following items for the Subdivision (collectively, the “Submission Items”):
(i) the preliminary plat for the Subdivision;
(ii) Geotechnical and soil reports;
(iii) Existing Environmental Reports (hereinafter defined); and
(iv) evidence of the availability of water and sanitary sewer service to the Subdivision in sufficient capacity to serve all the Lots.
(v) construction plans for the Subdivision (including, without limitation, the utility plans, drainage plans, detention plans and street plans);
(vi) Drainage Plan for the Subdivision; and
(vii) if applicable, the plans (collectively, the “Common Area Plans”) for fencing, screening, entryway, signage and amenities (collectively, the “Common Area Improvements”).
Submission Items. All Submission Items delivered or made available, or to be delivered or made available to Purchaser pursuant to this Agreement, are or upon submission will be actual copies of those maintained in Seller’s records in the ordinary course, but Seller makes no representation or warranty as to such Submission Item’s completeness and/or accuracy.
Submission Items. Within five (5) Business Days after the Effective Date, Seller shall deliver the Submission Items to Purchaser. Except as otherwise expressly provided in this Agreement, Purchaser acknowledges and agrees that Seller has not made and is not making any representations or warranties regarding the Submission Items, and Purchaser relies on the Submission Items at its own risk.
Submission Items. Within twenty (20) days after the Effective Date, Seller shall furnish to Purchaser or Purchaser shall obtain the following:
(a) Copies of the tax statements on the Land and the Improvements for the three (3) calendar years preceding the Effective Date.
(b) A list of personal property, if any, to be conveyed to Purchaser at Closing.
(c) The Certificate(s) of Occupancy for the Improvements and any amendments thereto, and a zoning verification letter issued to Purchaser from the City of San Antonio.
(d) An ACORX xxxtificate of insurance summarizing the policies covering or affecting the Project, both casualty and liability.
(e) A phase I environmental report (the "Environmental Report") certified to Purchaser evidencing the lack of any Hazardous Substances (hereinafter defined) on the Project. As used herein, "Hazardous Substances" shall mean and include, but shall not be limited to, all substances and materials which are included under or regulated by any local, state or federal law, rule or regulation, pertaining to environmental regulation , contamination, clean-up or disclosure ("Applicable Environmental Laws"), including, without limitation, the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (42 U.S.C. ss. 9601 et seq.), the Resource, Conservation and Recovery Act (42 U.S.C. ss. 6901 et seq.), Superfund Amendments and Reauthorization Act of 1986 (Pub. L. 99-400 000 Xxxt. 1613), the Toxic Substances Control Act (15 U.S.C. ss. 2601 et seq.), the Emergency Planning and Community Right to Know Act of 1986 (42 U.S.C. ss. 1101 et seq.) and all amendments of the foregoing, or any state superlien or environmental clean-up or disclosure statutes. Without limiting the foregoing, the term Hazardous Substances shall include asbestos, asbestos containing materials, polychlorinated biphenyls, petroleum products and raw materials which include hazardous constituents.

Submission Items. To Seller’s actual knowledge, the Seller’s Disclosure Materials are, or upon submission will be, complete and correct copies of such items as are in Seller’s possession or control. Seller has not intentionally altered, modified, redacted or otherwise changed any such materials, including the Seller’s Disclosure Materials.
