Common use of Subordinated Obligations Clause in Contracts

Subordinated Obligations. Except as permitted by the terms of the applicable subordination agreement, the Borrower shall not directly or indirectly (a) make any payment with respect to any Subordinated Debt; (b) amend or modify any Subordinated Debt in such a manner as to affect adversely the Lender; or (c) prepay or redeem all or any part of any Subordinated Debt.

Except as previously and expressly consented to in writing by Lender or permitted by the terms of the applicable subordination agreement, the Borrower shall not directly or indirectly permit (a) make any payment with to be made in respect to of any Subordinated Debt; (b) amend the amendment, rescission, or modify other modification of the provisions of any of Borrower's Subordinated Debt in such a manner as to affect adversely Lender's Liens or the Lenderprior position of such Liens; or (c) prepay the prepayment or redeem redemption of all or any part of any Subordinated DebtDebt of Borrower.
