Common use of Subordination May Not Be Impaired by the Company Clause in Contracts

Subordination May Not Be Impaired by the Company. No right of any holder of Senior Debt of Holdings or any Guarantor to enforce the subordination of the Guarantee of Holdings or such Guarantor (as the case may be) shall be impaired by any act or failure to act by Holdings or such Guarantor (as the case may be) or by its failure to comply with this Indenture.

Subordination May Not Be Impaired by the Company. No right of any holder of Senior Debt of Holdings or any Subsidiary Guarantor to enforce the subordination of the Guarantee of Holdings or such Guarantor (as Indebtedness evidenced by the case may be) Subsidiary Guarantees shall be impaired by any act or failure to act by Holdings the Company, any Subsidiary Guarantor or such Guarantor (as the case may be) any Holder or by its the failure of the Company, any Subsidiary Guarantor or any Holder to comply with this Indenture.
