Common use of Subordination May Not Be Impaired by the Guarantors Clause in Contracts

Subordination May Not Be Impaired by the Guarantors. No right of any holder of Senior Debt of the Guarantor or Additional Guarantors to enforce the subordination of the Indebtedness evidenced by the Guarantees shall be impaired by any act or failure to act by any Guarantor or Additional Guarantor or by the failure of any Guarantor or Additional Guarantor to comply with this Indenture.

No right of any holder of Senior Debt Indebtedness of the Guarantor or Additional Guarantors to enforce the subordination of the Indebtedness evidenced by the Guarantees Securities shall be impaired by any act or failure to act by any Guarantor or Additional Guarantor or by the its failure of any Guarantor or Additional Guarantor to comply with this Indenture.
