Common use of Subpoenas Directed to BellSouth Clause in Contracts

Subpoenas Directed to BellSouth. Where BellSouth provides resold services for ComSouth, BellSouth shall respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to ComSouth customers. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. BellSouth shall maintain such information for ComSouth customers for the same length of time it maintains such information for its own customers.

Where BellSouth provides resold services or local switching for ComSouthComm South, BellSouth shall respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to ComSouth customersComm South end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. BellSouth shall maintain such information for ComSouth customers Comm South end users for the same length of time it maintains such information for its own customersend users.

Where BellSouth provides resold services for ComSouthXxxxxxxx Communications, BellSouth shall respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to ComSouth Xxxxxxxx Communications customers. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. BellSouth shall maintain such information for ComSouth Xxxxxxxx Communications customers for the same length of time it maintains such information for its own customers.

Where BellSouth provides resold services for ComSouthBudgeTel, or, if applicable under this Agreement, switching, BellSouth shall respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to ComSouth BudgeTel customers. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. BellSouth shall maintain such information for ComSouth BudgeTel customers for the same length of time it maintains such information for its own customers.

Where BellSouth provides resold services for ComSouthAllSouth Phone, BellSouth shall respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to ComSouth AllSouth Phone customers. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. BellSouth shall maintain such information for ComSouth AllSouth Phone customers for the same length of time it maintains such information for its own customers.
