Common use of Subscription for Less Than Entitlement Clause in Contracts

Subscription for Less Than Entitlement. The holder of any Warrant may subscribe for and purchase a whole number of Subject Securities which is less than the number which the holder is entitled to purchase pursuant to a surrendered Warrant Certificate. In such event, the holder thereof will be entitled to receive a new Warrant Certificate in respect of the balance of Subject Securities which such holder was entitled to purchase pursuant to the surrendered Warrant Certificate and which were not then purchased. Such new Warrant Certificate shall bear the same legends, as set forth in subsection 2.2, which the surrendered Warrant Certificate bears.
