Subsequent Breach Sample Clauses

The Subsequent Breach clause defines how breaches of contract that occur after an initial breach are to be handled. Typically, this clause clarifies whether a party’s failure to enforce rights after an earlier breach affects their ability to act on later breaches, or it may specify that each breach is treated independently. For example, if a party repeatedly fails to meet delivery deadlines, this clause ensures that each missed deadline can be addressed separately. Its core function is to preserve the non-breaching party’s rights and remedies for future or repeated breaches, preventing a waiver of rights due to inaction on earlier violations.
